1. Who we are
These terms are between you and Freshnfab LLC (“Freshnfab”, “we”, “us”). We build websites for small businesses.
- Email: contact@freshnfab.co
- Phone (calls and texts): (801) 348-3342
- Mail: Freshnfab LLC, 7533 S Center View CT, West Jordan, UT 84084, USA (business location where we receive mail)
By using freshnfab.co, paying for a package or signing up for Monthly care, you agree to these terms. If you’re agreeing for a business, you confirm you’re allowed to do so for that business.
These terms cover our website services and our event planning and decor services (run by Tahia). A short events section is in section 20.
Our services are written for US businesses.
2. Our services
Website packages (paid once)
- Starter, $990: a website of up to 5 pages. Hosting, a domain and maintenance are not included. At launch you get full access to the code and to your accounts.
- Pro, $1,290: everything in Starter, plus hosting, a domain and security updates for the first year, only if you don’t already have them. If you already own hosting or a domain, we use yours. The package price does not change, and there is no credit or partial refund for unused hosting or domain. From year 2, you pay hosting and domain renewals yourself (or through Monthly care, if you choose it).
- Peace of Mind, $1,690: everything in Pro, plus, for the first year: monthly site updates, priority support, a monthly performance report, visibility advice, phone and message support, and ongoing SEO. For these services, you grant us written access to your code repository and host. We may withdraw that access if payment stops.
Monthly care (optional, billed monthly)
- Hosting & Care, $29 a month: hosting and your domain, security updates, saved and versioned backups, and a daily site check.
- Care Plus, $79 a month: everything in Hosting & Care, plus monthly site updates, priority support and a monthly performance report.
- Grow, $199 a month: everything in Care Plus, plus ongoing SEO and visibility advice.
What the terms mean
- Priority support means we reply within 1 business day. It doesn’t mean the issue is fixed within 1 business day.
- Monthly site updates means up to 1 hour of content changes per month on your existing pages. Unused time does not roll over. It covers text, image and simple layout edits. New pages and new features do not count and are quoted separately.
- Basic SEO, Advanced SEO, Ongoing SEO and visibility advice mean work and advice to help your site show up in search. We do not guarantee a specific PageSpeed or search ranking result (see section 10).
- A business day is Monday to Friday, excluding US federal holidays, in Mountain Time.
What’s not included in any package
- More than 5 pages, online booking, scheduling, online stores and custom apps. These are bigger projects. We give you a separate fixed-price quote before any work starts.
- Paid ads and their ad spend, and professional photography.
- Images: you can send us your own. If you don’t have any, we’ll talk about options together.
- Third-party fees you choose to take on, such as paid plugins, premium email or booking tools.
Maintenance and Peace of Mind — what’s included and what’s not
Included (as listed for your package or Monthly care tier): security updates while covered, versioned backups where offered, daily site checks where offered, monthly site updates within the limits above, priority support, performance reports, visibility advice, and ongoing SEO work as labeled.
Not included / not promised
- Search rankings, traffic, leads, sales or AI-search mentions
- Resolving hacks, malware cleanup, or security incidents caused by outside attacks, weak passwords, or third-party tools (we can quote recovery work separately)
- New pages, new features, redesigns, booking, e-commerce, or other bigger projects
- Unlimited support time or same-day fixes
- Work outside the monthly update cap
3. How a project works
- Quick review. We talk about what you need and agree on the package and price.
- You pay. You pay the full package price up front through a secure Stripe payment link. We start once payment clears.
- Homepage design. We design your homepage. You get 2 rounds of changes, then you approve it.
- Build and launch. We build the rest of your site, test it and take it live.
Timelines are estimates, not guarantees. We aim for 7–14 business days. The clock starts once we have your content and you’ve approved the homepage design. The estimate includes 2 rounds of changes. It doesn’t include time taken by Google or other outside services, for example to verify your business. Delays on your side, such as late content or feedback, move the timeline.
What’s in a revision round (and what isn’t)
Each included revision round covers reasonable feedback on the current approved scope: copy tweaks, image swaps, color and typography adjustments, and small layout refinements on pages already in the package.
Not included in a revision round (and quoted separately if you ask for them):
- Adding pages beyond the package page count (packages are up to 5 pages)
- Changing the site architecture (for example a new sitemap, new navigation model, or restructuring major sections)
- Adding major features such as booking, scheduling, online stores, memberships or custom apps
- Changing domain or hosting setup after work has started (for example a new registrar, a host migration, or a different DNS plan), except as already included in your package for year 1
- Redesigning from scratch after you approved the homepage direction
More changes. Changes beyond the 2 included rounds, or anything in the “not included” list above, may cost extra. We’ll tell you the price before doing the work (usually a fixed quote for that change).
Quotes. A written quote or order we send you is valid for 30 days from the date on it, unless the quote says otherwise. After that we may update the price or scope.
If a project stalls. If we don’t hear from you for 30 days after we ask for content or feedback, we may pause your project. If it stays paused for 90 days, we may close it. Closing a stalled project does not create a refund beyond section 4.
Key person unavailable. If the main person on our side who is building your site becomes unavailable (illness, leave, or similar), we’ll tell you promptly, propose a revised schedule, and keep your project moving with another team member when we can. That delay does not by itself create a refund or a breach, as long as we keep working toward launch in good faith.
4. Payments, taxes and refunds
- Prices are in US dollars. Prices exclude applicable taxes. If sales tax applies, we’ll add it to your bill.
- Payments go through Stripe. We never see or store your full card number.
- Package refunds (you pay in full up front): you get a full refund if you cancel before homepage design work starts. Once homepage design work has started, there is no refund, including when you have already paid the full package price. “Homepage design work has started” means we have begun designing your homepage after your payment cleared. If you cancel after that point, we keep the payment for work already begun and for holding the project slot.
- If a payment is disputed or charged back without contacting us first, we may pause work and services until it’s resolved.
5. Monthly care billing and cancellation
- Monthly care is billed monthly through Stripe, starting on the day you sign up. It renews each month until you cancel.
- Cancel anytime. You can cancel in the Stripe customer portal or from the link on your receipt, or just email us. Your Monthly care runs until the end of the month you’ve already paid for. We don’t give refunds for partial months.
- If a payment fails, Stripe will try again. If it still isn’t paid after 14 days, we may pause the service. If we pause hosting, your site may go offline. For Peace of Mind (and any service that needs repo or host access), we may also withdraw that access.
- Price changes: we’ll email you at least 30 days before a new price applies. You can cancel before then.
- Pro and Peace of Mind year 1 hosting and domain: included only when you don’t already have them. If you already own either, we use yours; the package price stays the same; there is no credit or partial refund. From year 2, you pay the renewals (hosting and domain), unless you sign up for Monthly care, which covers them.
- Pro and Peace of Mind after year 1: year-1 services end 12 months after launch. To keep hosting and domain renewals covered after that, choose any Monthly care option, or handle renewals on your own accounts. We’ll remind you about 30 days before year 1 ends.
6. Your content, legal pages and warranties
- You warrant that you have (and will keep) all rights needed for the content you give us — text, logos, photos, videos, fonts, reviews, trademarks and claims about your business — and that using that content as you ask does not infringe anyone else’s rights or break the law.
- You’re responsible for the accuracy and legality of that content.
- We are not lawyers. Any sample wording, templates or checklists we share are not legal advice.
- You are responsible for your own legal pages and compliance, including your privacy policy, terms, industry disclosures, and cookie / tracking consent where the law requires it. You’re also responsible for how your site collects and uses visitor data.
- If your site collects personal data, for example through a contact form, you’re responsible for handling it lawfully.
- You won’t ask us to publish anything illegal, misleading, infringing, hateful or harmful. We may refuse or remove that kind of content.
- Please keep your logins safe and tell us quickly if you think an account is compromised. Don’t send passwords or sensitive personal data by message (see our Privacy Policy).
- You’ll reply to our questions within a reasonable time, so we can keep your project on track.
7. Ownership and accounts
- Your site is 100% yours, from day one. Once you’ve paid, you own the website we build for you, its code and its content, plus your own content and trademarks.
- Code: the code lives in your GitHub account (or another repository you control). We recommend GitHub if you don’t already use a repository.
- Domain and hosting: you choose your own domain registrar and host. We recommend a host compatible with our workflow (for example, one that supports modern Next.js sites). We do not require a specific host brand in these terms.
- Starter: hosting and a domain are not included. At launch you get full access to the code and to your accounts.
- Pro and Peace of Mind: if we include domain and/or hosting for year 1 because you don’t already have them, we’ll confirm with you in writing how those accounts are set up for that first year. If you already own either, we use yours. From year 2, renewals are yours (or Monthly care’s), as in section 5.
- Peace of Mind access: you grant us written access to the repository and host for the services included. We may withdraw that access if payment stops.
- If you leave, handover of your site, code and access is free. If the site is hosted by us as part of a service we provide, it stays online for 30 days after that service ends, so you have time to move it.
- Our tools: we may reuse our own general know-how, building blocks and code patterns that aren’t specific to you on other projects. You get a permanent, free license to use any of them that are part of your site. Open-source pieces stay under their own licenses.
- Portfolio: we will not publish your site in our portfolio without asking you first.
8. Hosting, backups, site checks and third parties
- We use trusted outside providers for hosting, code hosting, payments, email delivery, domain services, fonts, analytics (if you add them), booking tools, chat widgets and similar services.
- Third-party tools and services are outside our control. Their own terms, pricing, outages, bugs and policy changes apply. We’re not responsible for their downtime, data loss, feature changes or how they handle your data.
- Backups: changes to your site are saved and versioned, so we can restore an earlier version. Keep your own copies of anything important too.
- Site checks: we check your site daily. We don’t promise any uptime percentage or a response time for outages, and there’s no service-level agreement.
- Security: we apply security updates for as long as your package year or your Monthly care covers it. No site can be made completely secure. We do not promise to prevent or resolve hacks (see section 2).
9. Accessibility
We build sites with care for everyday use on phones and computers. We do not guarantee that a site will meet any particular accessibility standard (for example WCAG), pass an automated audit, or satisfy every disability-access requirement.
If you need a specific accessibility standard, you must tell us in writing before we start (or before that work is added to the quote). We’ll then confirm in writing what we can do, what it costs, and what we can and can’t promise. Without that written statement up front, accessibility work beyond our normal careful build is out of scope.
10. No promises of results
We work hard to build sites that look good, load fast and are set up for search. Sites are built for fast loading and a strong Google PageSpeed score. Scores vary by device, network and tool, and can be lowered by embeds or content added later, such as booking widgets or videos. We do not guarantee a specific PageSpeed or search ranking result. Labels such as Basic SEO, Advanced SEO, Ongoing SEO and visibility advice describe the kind of work we do, not a promised ranking or traffic outcome.
We also can’t promise rankings, traffic, calls, leads, sales, revenue, AI-search mentions or citations, or uptime percentages. Search engines, AI tools and other platforms decide on their own, and they change often. Any reports or advice we share are information, not a guarantee.
11. Warranty and fix-it promise
We’ll do our work with care and skill. Other than what these terms say, our services and websites are provided “as is” and “as available.” As far as the law allows, we disclaim all other warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don’t promise that a site will be error-free or always available.
Fix-it promise: if something we built doesn’t work as agreed within 30 days of launch, tell us and we’ll fix it at no charge.
The fix-it promise does not cover problems caused by:
- Your misuse of the site or accounts
- Changes made by you or by a third party (another developer, a plugin you installed, or edits outside our process)
- Faults, outages or limits of your host, registrar, CDN, email provider or other infrastructure
- Faults in third-party plugins, embeds, themes or services
- Content, data or settings you supplied
- Hacks, malware or security incidents (we can quote cleanup separately)
12. Limitation of liability — waiver of indirect damages
As far as the law allows, you waive and we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data, goodwill or business opportunities, even if we were told they were possible.
Our total liability for any claim is limited to the amount you paid us for the service involved in the 12 months before the claim.
Some states don’t allow some of these limits. Where that’s the case, the limits apply as far as the law allows.
13. Indemnity
Each party remains responsible for its own content and for following these terms. There is no broader indemnity clause in these terms.
14. AI-assisted copywriting
We may use AI tools to help draft website copy or other wording for your project. A member of our team reviews and edits that work before it goes to you.
We’ll tell you when AI-assisted copywriting is part of your project. You may opt out of AI-assisted copywriting by telling us in writing before that work starts (or as soon as we disclose it). If you opt out, we’ll write that copy without AI drafting tools; the timeline or price may change, and we’ll confirm that with you first.
This section is about copywriting for your site. How we use AI on messages to our business accounts is covered in our Privacy Policy.
15. Ending our work together
- You can stop a project or cancel Monthly care at any time by emailing us. Refunds follow section 4 (packages) and section 5 (Monthly care).
- We can end our services if you seriously break these terms, don’t pay, or ask us to publish illegal content. We’ll give you notice by email first when we reasonably can.
- After it ends, we’ll hand over your site and accounts as described in section 7. If the site is hosted by us, it stays online for 30 days after service ends, and handover is free.
- Sections that should naturally continue after the end, like ownership, payments owed, disclaimers, limits of liability and governing law, still apply.
16. Messages from us
We send service emails and texts about your project, billing and your site. A real person reads and answers texts and calls. We don’t send automated marketing texts. We don’t send marketing emails for now; if we ever do, they’ll include an easy opt-out. If you’d rather not get texts, tell us and we’ll use email.
17. Changes to these terms
We may update these terms from time to time. We’ll post the new version here with a new “Last updated” date. If a change materially affects active clients, we’ll email you at least 30 days before it applies. The terms in place when you paid for a package keep applying to that package.
18. Governing law and disputes
- These terms are governed by the laws of the State of Utah, without regard to its conflict-of-laws rules.
- Before either of us files a court case (other than small claims, or a request for emergency relief the law allows), that party must give the other written notice of the dispute and a chance to resolve it. We’ll then negotiate in good faith for 30 days from that notice.
- If we still can’t resolve it, disputes go to the state or federal courts in Salt Lake County, Utah. Small claims court is allowed. Clients outside Utah may still bring a small claims case in their own county where the law allows.
19. The rest
- These terms, together with any written quote or order we agree on, are the whole agreement for our services. If a written quote conflicts with these terms, the quote wins for that project. Quotes are valid for 30 days unless they say otherwise (see section 3).
- If part of these terms can’t be enforced, the rest still applies.
- If we don’t enforce a right right away, we can still enforce it later.
- You can’t transfer these terms without our OK. We may transfer them if our business changes hands, and we’ll tell you if that happens.
- Neither of us is responsible for delays caused by things outside our reasonable control, such as outages of outside providers, natural disasters, internet failures, or a key person becoming unavailable as in section 3.
20. Events and decor
Tahia runs Freshnfab’s event planning and decor services, mainly in Salt Lake City and nearby. Event work is covered by these same terms, with a separate fixed-price quote before any work starts. Ownership of event designs and materials, deposits and cancellations for a specific event are set out in that quote. Sections on payments, content, liability and governing law still apply. Deposit rules for events may differ from website packages; the event quote controls.
